前文 Preamble
  • 北本市は、平成２１年に「自らのことは自らが決し、その責任は自らが負う」という自治の理念の下、北本市におけるまちづくりの最高規範である北本市自治基本条例（平成２１年条例第２２号）を制定しました。
  • 今日、地方分権が進む中で、本市議会が、地域における民主主義の発展と市民福祉の向上のために果たすべき役割や責務は、ますます大きくなっています。
  • 本市議会は、日本国憲法で定められた住民を代表する議事機関であり、二元代表制の一翼として、住民の信託に応え、市民の意思を的確に市政に反映させる責務があります。
  • 同時に、自由かつ充実した討議を行い、立法機能や監視機能などを十分発揮することによって、言論の府である議会の役割や責務を全うする使命が課せられています。
  • 地方自治体の自主的な決定と責任の範囲が拡大した今、市議会としての役割や責務を果たすために、議会の活動に関する様々な情報を発信して、市民参画及び市民との協働を推進し、市民にとって身近で開かれた、信頼される議会を実現する必要があります。
  • よって、本市議会は、自ら議会改革を推し進め、議会の権能を更に高めていくことを決意し、この条例を制定します。
  • In 2009,under the autonomy principle of "We decide by ourselves,and we will be responsible for the results by ourselves.”,Kitamoto City established the Basic Ordinance of Autonomy, as　the highest standard of urban planning.(Ordinance No. 22, 2009).
  • Now, as decentralization progresses, the role and responsibility of the City Council to develope democracy and to improve civic welfare is becoming more and more in the region.
  • As the Constitution of the Japan country prescribed, this City Council is a decision making system on behalf of the inhabitants and as a wing of the dual representation system, this City Council has a responsibility to respond to the trust of inhabitants and reflect the intentions of the citizens to the city government precisely.
  • At the same time, the City Council has a mission to fulfill the role and responsibilities of the City Council, which is the center of speech,by providing a free and fulfilling discussion, and demonstrating the legislative function and monitoring function.
  • Now that the voluntary decisions and responsibilities of local governments have expanded, to fulfill the role and responsibilities of the City Council, it is necessary to disseminate various information about the activities of the City Council to promote civic planning participation and cooperation with citizens, and to realize a council that is open and trusted to citizens.
  • Therefore, the City Council will voluntarily promote the reform of the Council and decide to further enhance the authority of the City Council, and enact this ordinance.
第１章　総則 Chapter 1: General Provisions
  • （目的）
  • 第１条
  • この条例は、議会の役割及び責務を果たすための基本的な事項を定めることにより、市民に信頼される議会の実現を図り、もって市民福祉の向上及び市政の発展に寄与することを目的とする。
  • (Purpose)
  • Article 1
  • The purpose of this ordinance is to achieve the City Council which is trusted by the citizens by setting the basic matters to fulfill the role and the responsibility of the City Council, and to contribute to the improvement of the civil welfare and the development of the municipal government.
  • （この条例の位置付け）
  • 第２条
  • この条例は、議会運営における最高規範であって、議会に関する他の条例等を制定し、又は改廃するときは、この条例の趣旨を尊重し、この条例に定める事項との整合性を図るものとする。
  • (Position of this ordinance)
  • Article 2
  • This ordinance is the highest standard in the management of the City Council, and when the other ordinances etc. Concerning the City Council are enacted or abolished, the purpose of this Ordinance is esteemed, and the consistency with the matter set forth in this Ordinance shall be considered.
  • （定義）
  • 第３条
  • この条例において、次の各号に掲げる用語の意義は、当該各号に定めるところによる。
  • (1)市民 市内に住み、市内で働き、若しくは市内で学ぶ人又は市内に事業所を置き、市内で事業活動を行う者をいう。
  • (2)市長等：市長その他の執行機関をいう。
  • (Definition)
  • Article 3
  • In this Ordinance, the meaning of the term listed in each of the following issues shall be determined in the respective items.
  • (1)citizen: A person who lives in City, works in the city, or places a business place in the city or operates in the city.
  • (2)mayor etc.：The mayor and other executive bodies.
  • （議会の役割）
  • 第４条
  • 議会は、次の各号に掲げる役割を担うものとする。
  • (1)議事機関として、議案の審議及び審査を行い、本市の意思決定を行うこと。
  • (2)市長等の事務執行について監視し、政策の効果を適切に評価すること。
  • (3)市政の課題等について調査を行い、政策立案及び提言を行うこと。
  • (4)決議、意見書等により、国又は関係行政庁に対し、意見表明を行うこと。
  • (Role of the City Council )
  • Article 4
  • The City Council shall assume the role listed in the following issues.
  • (1)As a decision making system,to deliberate and to review the bill and to make the decision of the city.
  • (2)To monitor the office execution of the mayor, etc., and to evaluate the effect of policy appropriately.
  • (3)To conduct research on the issues of the municipal government,and to conduct policy planning and recommendations.
  • (4)By resolutions, opinions, etc. to express the will of the City Council to the National Government or other agencies concerned.
第２章　議会及び議員の活動原則 Chapter 2: Principles of the activities of the City Council and members
  • （議会の活動原則）
  • 第５条
  • 議会は、その役割を果たすため、次の各号に掲げる原則に基づき活動するものとする。
  • (1)住民の代表機関であることを常に自覚し、公正性、透明性及び信頼性を重んじた、市民にわかりやすい開かれた議会を目指すこと。
  • (2)議会が、討議の場であるとの認識に立って、市民の参加の機会を確保し、市政の課題等の解決のために尽力すること。
  • (3)自由かったつな討議を行い、市政の課題等に関する論点及び争点を明らかにし、政策提言、政策立案等に努めること。
  • (4)議会の活動について、積極的な情報公開を行い、もって市民への説明責任を果たすこと。
  • (5)積極的な調査研究活動に努めるとともに、継続的な議会改革に取り組むこと。
  • (Activity principal of the City Council)
  • Article 5
  • The City Council shall, in order to fulfill its role, act on the principles set forth in the following issues.
  • (1)In recognition of being a representative organization of the inhabitants, and by respecting, fairness, transparency, citizens reliability to aim to be open council that is easy to understand.
  • (2)In recognition of being a place for discussion, to ensure the opportunity for citizens to participate and strive to solve the problems of the city administration.
  • (3)Through a free and generous discussion to clarify issues and issues related to the city's problems, and to make policy recommendations and policies.
  • (4)To disclose information about the activities of the City Council actively and to fulfill accountability to citizens.

  • 議員は、その役割を果たすため、次の各号に掲げる原則に基づき活動するものとする。
  • (1)議員は、議会が合議制の機関であることを認識し、議員相互間の自由な討議を推進すること。
  • (2)市政の課題等について、市民の多様な意見を把握するとともに、自己の資質向上に努め、市民の信頼に応える活動をすること。

  • (4)市民に対し、自らの議員活動について説明すること。
  • (5)市政に関して、調査及び研究を行うとともに、必要に応じ議案を提案すること。

  • (Activity principal of the City Council members)
  • Article 6
  • In order to fulfill its role, the City Council members shall act in accordance with the principles set forth in the following matters.
  • (1)In recognition of being a collegiate institution, to promote a free discussion among menbers.
  • (2)To understand the various opinions of citizens about the issues of the city, and to work to improve their own qualities and to respond to the trust of citizens.
  • (3)To conduct activities aiming to improve the welfare of the entire citizen.
  • (4)To explain menbers own activities.
  • (5)To conduct research and study on the municipal government and to propose bills if necessary.
  • (6)To endeavor to prioritize activities of the City Council.
  • （議員の政治倫理）
  • 第７条
  • 議員は、住民全体の代表者として高い倫理観を持って、誠実かつ公正に活動するものとする。
  • ２　前項に規定するもののほか、議員の政治倫理に関する事項については、別に条例で定める。
  • (The City Council member's political ethics)
  • Article 7
  • The City Council members shall act faithfully and fairly, with high ethical views as a representative of the entire inhabitants.
  • 2. In addition to the provisions prescribed in the preceding paragraph, the matters concerning the political ethics of menbers shall be stipulated separately by another ordinance.
第３章　市民と議会との関係 Chapter 3: Relationship between citizens and the City
  • （市民の参加の機会の充実）
  • 第８条
  • 議会は、公聴会及び参考人制度等の活用や広報広聴機能の強化により、市民の多様な意見を把握し、議会活動に反映させるとともに、市民が議会の活動に参加する機会の充実に努めるものとする。
  • ２　議会は、市民の参加の推進に努めるとともに、市民との意見交換の場を設けるものとする。
  • (Enhancement of opportunities for civic participation)
  • Article 8
  • Through the use of hearing and reference systems, and the enhancement of public relations listening functions, the City Council shall grasp the diverse opinions of citizens, and reflect them in the City Council activities, and make efforts to enhance the opportunities for citizens to participate in the City Council activities.

  • 議会は、会議を原則公開とする。
  • ２　議会は、会議で用いた資料について積極的な公開に努めるとともに、市民が傍聴しやすい環境の整備に努めるものとする。

  • The City Council shall publicly disclose the conference.

  • 第１０条
  • 議会は、請願及び陳情を幅広い提案又は意見と位置付け、適切に処理するものとする。
  • ２　議会は、請願及び住民による陳情の提案者から申出があったときは、 当該提案者の意見を聴く機会を設けることができるものとする。
  • ３　議会は、採択した請願及び住民による陳情のうち市長等において措置することが適当と認めるものについては、市長等に送付した後、その処理の経過及び結果の報告を求めるものとする。

  • 議会は、市民に対する説明責任を果たすとともに、市民との意見交換を通して多様な課題の解決に取り組むために、議会報告会を開催するものとする。

  • The City Council shall hold a briefing meeting to fulfill accountability to its citizens and to address various issues through the exchange of views with the citizens.

  • 議会は、円滑かつ民主的な議会運営等を推進するため、住民のうちから議会運営に関する意見の提出等を行う議会モニターを設置することができる。
  • ２　前項の議会モニターに関し必要な事項は、議長が別に定める。
  • (Establishment of a City Council monitor system)
  • Article 12
  • The City Council may set up a City Council monitor system to provide opinions on the management of the legislature from among its inhabitants in order to promote a smooth and democratic operation, etc.

第４章　議会と市長等との関係 Chapter 4: Relations between the City Council and the Mayors
  • （市長等との関係）
  • 第１３条
  • 議会と市長等との関係は、その立場及び権能の違いを踏まえ、緊張関係の保持に努めるものとする。
  • ２　議会は、市長が提案する重要な政策、施策、計画、予算等（以下「政策等」という。）については、議会審議を通じて政策水準の一層の向上を図るため、市長に対し、必要な情報を明らかにするよう求めるものとする。
  • (Relations with mayors, etc.)

  • The relationship between the City Council and the mayor shall be endeavored to maintain the tense relationship in recognition of the differences between the position and the authority.
  • 2. The City Council, concerning about an important policy, a measure, a plan, a budget, etc. (hereinafter referred to as "policy"),shall require the mayor to disclose necessary information in order to further improve the level of policy through the City Council deliberations.

  • 第１４条
  • 議会は、提案される政策等について、議会審議に資するため、提案者に対し、次の各号に掲げる事項について明らかにするよう求めるものとする。
  • (1)政策等の提案に至った経緯又は理由
  • (2)検討した他の政策等案の内容
  • (3)他の自治体の類似する政策等との比較検討
  • (4)市民参加の実施の有無とその内容
  • (5)総合計画における根拠又は位置付け
  • (6)根拠法令、根拠条例等
  • (7)政策等の実施に要する経費及び財源
  • (8)将来にわたる政策等の効果及び経費
  • ２　議会は、政策等及び決算を審議するに当たっては、立案及び執行における論点及び争点を明らかにするとともに、執行後における政策評価に資する審議に努めるものとする。
  • (Collection of information on the formation process of policy, etc.)

  • (7)Expenses and financial resources for the implementation of the policy, etc.
  • (8)Effects and expenditure of future policies
  • 2. The City Council, in deliberating policies, etc.and the settlement of account, shall endeavor to clarify the issues in the planning and execution of the program and shall make efforts to contribute to the policy evaluation after execution.
  • （反問権の付与等）
  • 第１５条
  • 会議において、議員の質問又は質疑（以下「質問等」という。）に対し答弁をする者は、質問等の論点及び根拠等を明確にするため、議長又は委員長の許可を得て、反問することができる。
  • ２　議員は、会議において質問等を行うに当たっては、質問等の論点及び根拠を明確にし、市民に分かりやすい方法で行うよう努めるものとする。
  • ３　議員の市長等に対する質問は、広く市政の課題に関する論点及び争点を明らかにするため、一問一答の方式で行うことができる。
  • ４　議長は、議員又は委員会による条例の提案及び議案の修正の提案に対し市長等が意見を述べる機会を与えることができる。
  • (Granting of return question rights, etc.)
  • Article 15
  • In the meeting, concerning about the interpellation or question of the City Council members (hereinafter referred to as "questions")..the person who answers to the question, etc., can do return question in order to clarify the questions and grounds, etc., by obtaining the permission of the Chairperson.
  • 2. In the case of a meeting, the City Council members shall make clear the issues and grounds of questions, and endeavor to do so in a way that is understandable to the citizens.
  • 3. In the asking to the mayer, etc., the City Council members can ask questions and get answers one by one, in order to broadly identify issues and issues related to the city's problems.
  • 4. The Chairperson may provide an opportunity for the mayor or other to give an opinion on the proposal of an ordinance or a proposal to amend the bill by a City Council member or a committee.
  • （閉会中の文書による質問）
  • 第１６条
  • 議員は、閉会中に議長を経由して、市長等に対し文書により質問を行い、文書による回答を求めることができる。
  • ２　前項の閉会中の文書による質問に関し必要な事項は、議長が別に定める。
  • (Questions by document during the closing period of the City Council)
  • Article 16
  • The City Council members, during the closing period of the City Council, through the Chairperson, may ask the mayor or other questions by document and request a written answer.
  • 2. The Chairperson shall separate any necessary matters of the preceding paragraph pertaining to the written questions during the closing period.

  • 第１７条
  • 地方自治法（昭和２２年法律第６７号。以下「法」という。）第９６条第２項に規定する議会の議決すべき事件は、次に掲げるものとする。
  • (1)基本構想（北本市自治基本条例第１１条第１項に規定する基本構想をいう。以下同じ。 ）の策定、変更又は廃止に関するもの
  • (2)基本計画（基本構想を実現するための基本的な計画で、市政全般に係る政策及び施策の基本的な方針を総合的かつ体系的に定めるものをいう。 ）の策定、変更又は廃止に関するもの
  • ２　議会は、前項各号に掲げる事件の審議において、市長等とともに市民に対する責任を担いながら、計画的、かつ、市民の視点に立った透明性の高い市政運営となるよう議論に努めるものとする。

第５章　議会運営 Chapter 5: the City Council operation
  • （定例会）
  • 第１８条
  • 法第１０２条第２項に規定する議会の定例会の回数は、毎年４回とする。
  • ２　議会の定例会は、毎年３月、６月、９月及び１２月に招集する。ただし、都合により繰り上げ、又は繰り下げることができるものとする。
  • ３　議会は、必要な審議日数を適切に確保し会期を定めるものとする。
  • (The regular conference)
  • Article 18
  • The number of regular conference of the City Council, as stipulated in article 102, paragraph 2 of the law (regular meeting), shall be four times annually.
  • 2. The regular meetings of the City Council are convened in March,June, September and December every year.However, it shall be able to change back and forth by circumstances.
  • 3. The City Council shall properly secure the required day of deliberations and determine the period.
  • （議長及び副議長）
  • 第１９条
  • 議長は、議会の代表者として、中立かつ公平な立場においてその職務を行い、民主的かつ公正な議会運営を行わなければならない。
  • ２　議長は、議場の秩序を保持し、円滑な議事運営に努めるものとする。
  • ３　前２項の規定は、副議長が議長の職務を行う場合に準用する。
  • (Chairperson and vice chairperson)
  • Article 19
  • The Chairman of the City Council shall perform its duties in a neutral and impartial position as a representative of the City Council and perform a democratic and fair City Council operation.

  • 議会は、災害時においても、議会機能を的確に維持しなければならない。
  • ２ 災害時の議会の行動基準等に関しては、議長が別に定める。

  • 第２１条
  • 常任委員会、議会運営委員会及び特別委員会（以下「委員会」という。）は、調査、研究及び審査を充実させるため、必要に応じて委員相互間の討議を行うよう努めるものとする。
  • ２　委員会は、公聴会及び参考人制度の活用に努めるものとする。
  • ３　委員会は、政策立案及び政策提案を積極的に行うよう努めるものとする。
  • ４　議会運営委員会は、法第１０９条第３項に規定する調査又は審査とともに、議会運営についての協議を行うものとする。
  • (Committee)
  • Article 21
  • Standing Committee, City Council Steering Committee and Special Committee (hereinafter referred to as "committee") shall endeavor to carry out discussions among the members of the Committee in order to enrich the investigation, research and examination.

  • 第２２条
  • 委員長は、委員会審査において円滑な委員会の運営に努めるものとする。
  • ２　委員長は、市民の要請に応えるため、所管委員会に係る市政の課題等に対し、常に問題意識を持って委員会を運営するよう努めなければならない。
  • ３　前２項の規定は、副委員長が委員長の職務を行う場合について準用する。
  • (Chairperson and Deputy Chairperson of committee)
  • Article 22

第６章　議会の機能強化と改革 Chapter 6: Strengthening and reform of the City Council
  • （議員相互の討議）
  • 第２３条
  • 議会は、言論の府であることを認識し、議員相互間の自由かったつな討議を中心とした会議の運営に努めるものとする。
  • ２　議会は、議案の審議及び審査においては、議員相互間の自由討議により議論を尽くして合意形成に努めるとともに、市民に対する説明責任を果たすものとする。
  • ３　議会は、市政に関する政策等及び課題等に対して議員相互間の共通認識及び合意形成を図り、意見集約がなされた内容について、条例の提案、議案の修正、決議等に向けた政策立案を行い、又は市長等に対し政策提言を行うものとする。
  • ４　議員は、議会の機能を発揮するため、積極的に議員相互間の自由討議に努め、議論を尽くすものとする。

  • Article 23
  • The City Council recognizes that it is a branch of speech, and seeks to run a conference with a focus on free and generous discussions among the City Council menbers.
  • 2. The City Council shall, in the deliberations and inspection of the bill, endeavor to make the consensus by free and exhorting discussion among the City Council members kers and to fulfill the accountability to the citizens.
  • 3. The City Council shall make a consensus and an agreement among the City Council members about policies and issues related to the city etc.,and shall make an ordinance, an amend of the bill,a resolution,or shall propose the te to the mayer.
  • 4. The City Council members shall endeavor to conduct free discussion actively to activate the function of the City Concil.
  • （専門的知見の活用）
  • 第２４条
  • 議会は、法第１００条の２に規定する学識経験を有する者等による専門的事項に係る調査を積極的に活用するものとする。

  • The City Council shall actively use investigations pertaining to specialized matters by persons who have the academic experience prescribed in article 100-2 of law.
  • （公聴会及び参考人制度の活用）
  • 第２５条
  • 議会は、本会議において、公聴会及び参考人制度の活用に努めるものとする。

  • Article 25
  • The City Council shall endeavor to use the hearings and the reference system in the main conference.
  • （審議会等の設置）
  • 第２６条
  • 議会は、審議会、審査会、調査会その他の審査、諮問又は調査のための機関を置くことができる。
  • ２　前項の審議会等の機関に関し必要な事項は、条例で別に定める。

  • ４　議会及び議員は、市政の課題等を広い視点から捉えるため、他の自 治体の事例等を調査研究するよう努めるものとする。

  • The City Council shall endeavor to enhance the study and training of the City Council members in order to improve the qualifications of the members.
  • 2. The City Council shall actively hold a the City Council study and training session with persons and citizens with academic experience.
  • 3. The City Council shall conduct study and training on this ordinance to the City Council promptly after the start of the term of the general election.
  • 4. The City Council and members shall endeavor to investigate the case of other municipalities in order to grasp the problems of the municipal government from a broad perspective.

  • 議会事務局は、議員の議会活動に必要とされる行政情報の収集及び提供に努めるものとする。
  • ２　議会は、議会の機能を充実させるため、議会活動を補佐する議会事務局の調査機能及び法務機能の充実強化並びに組織体制の整備を図るよう努めるものとする。

  • The secretariat of the City Council shall endeavor to collect and provide administrative information necessary for the City Council member's activities .

  • 議会は、議員の議会における審議及び調査研究に役立てるため、必要な資料等を収集保管し、議員に積極的な情報提供を行う等、議会図書室の充実強化に努めるものとする。
  • ２　議会は、議会図書室の市民等の閲覧利用に配慮するものとする。
  • ３　前２項に規定するもののほか、議会図書室に関する事項については、議長が別に定める。

  • The Assembly shall endeavor to enhance the Assembly library by collecting and storing necessary materials and providing positive information to lawmakers in order to use them for deliberations and research studies in Parliament.

  • 3. In addition to the provisions of the preceding two paragraphs,the Chairperson shall be set aside for matters pertaining to the Parliamentary library.

  • 第３４条
  • 議会は、継続的な議会改革に取り組むものとする。
  • ２ 議会は、前項の規定による取組を行うため、議員で構成する議会改革を推進する組織を設置することができる。
  • ３　議会は、必要があると認めるときは、前項の議会改革を推進する組織に学識経験を有する者等を構成員として加えることができる。
  • ４　議会改革を推進する組織に関する事項は、議長が別に定める。
  • (Promotion of parliamentary reforms)

  • The Congress shall address ongoing parliamentary reforms.
  • 2. The Congress may establish an organization that promotes parliamentary reforms constituted by lawmakers in order to make efforts under the provisions of the preceding paragraph.
  • 3. When the Congress finds it necessary, it is possible to add the person who has the academic experience to the organization which promotes the parliamentary reform of the preceding paragraph as a constituent member.
  • 4. The Chairman shall separate matters concerning the organization which promotes the reform of Congress.
第７章　議員定数、議員報酬等 Chapter 7: Number of the City Council members, remuneration of the City Council members, etc.

  • 法第９１条第１項に規定する議会の議員の定数は、２０人とする。
  • ２　議員の定数の変更に当たっては、市政の現状及び課題、将来の予測、市民の意見その他の事情を十分に考慮するものとする。

  • 政務活動費は、議会の充実等に資するため、議員の政策立案及び調査研究等の活動に充当できるものとする。
  • ２　政務活動費は、活動成果の報告に努める等、説明責任を果たし、適正に取り扱うものとする。
  • ３　前２項に規定するもののほか、政務活動費に関する事項については、別に条例で定める。

  • 議会は、議会運営委員会において、この条例の不断の検証に努め、市民の意見、社会情勢の変化等を勘案し、必要があると認める ときは、条例の見直しを行うものとする。

  • ２ 次に掲げる条例は、廃止する。
  • (1) 北本市議会定例会条例（昭和３１年条例第４号）
  • (2) 北本市議会の議員の定数を定める条例（平成１４年条例第３３号）

  • 北本市は、平成２１年に「自らのことは自らが決し、その責任は自らが負う」という自治の理念の下、北本市におけるまちづくりの最高規範である北本市自治基本条例（平成２１年条例第２２号）を制定しました。
  • 今日、地方分権が進む中で、本市議会が、地域における民主主義の発展と市民福祉の向上のために果たすべき役割や責務は、ますます大きくなっています。
  • 本市議会は、日本国憲法で定められた住民を代表する議事機関であり、二元代表制の一翼として、住民の信託に応え、市民の意思を的確に市政に反映させる責務があります。
  • 同時に、自由かつ充実した討議を行い、立法機能や監視機能などを十分発揮することによって、言論の府である議会の役割や責務を全うする使命が課せられています。
  • 地方自治体の自主的な決定と責任の範囲が拡大した今、市議会としての役割や責務を果たすために、議会の活動に関する様々な情報を発信して、市民参画及び市民との協働を推進し、市民にとって身近で開かれた、信頼される議会を実現する必要があります。
  • よって、本市議会は、自ら議会改革を推し進め、議会の権能を更に高めていくことを決意し、この条例を制定します。

  • In 2009,under the autonomy principle of "We decide by ourselves,and we will be responsible for the results by ourselves.”,Kitamoto City established the Basic Ordinance of Autonomy, as　the highest standard of urban planning.(Ordinance No. 22, 2009).
  • Now, as decentralization progresses, the role and responsibility of the City Council to develope democracy and to improve civic welfare is becoming more and more in the region.
  • As the Constitution of the Japan country prescribed, this City Council is a decision making system on behalf of the inhabitants and as a wing of the dual representation system, this City Council has a responsibility to respond to the trust of inhabitants and reflect the intentions of the citizens to the city government precisely.
  • At the same time, the City Council has a mission to fulfill the role and responsibilities of the City Council, which is the center of speech,by providing a free and fulfilling discussion, and demonstrating the legislative function and monitoring function.
  • Now that the voluntary decisions and responsibilities of local governments have expanded, to fulfill the role and responsibilities of the City Council, it is necessary to disseminate various information about the activities of the City Council to promote civic planning participation and cooperation with citizens, and to realize a council that is open and trusted to citizens.
  • Therefore, the City Council will voluntarily promote the reform of the Council and decide to further enhance the authority of the City Council, and enact this ordinance.

  • この条例は、議会の役割及び責務を果たすための基本的な事項を定めることにより、市民に信頼される議会の実現を図り、もって市民福祉の向上及び市政の発展に寄与することを目的とする。

  • The purpose of this ordinance is to achieve the City Council which is trusted by the citizens by setting the basic matters to fulfill the role and the responsibility of the City Council, and to contribute to the improvement of the civil welfare and the development of the municipal government.

  • この条例は、議会運営における最高規範であって、議会に関する他の条例等を制定し、又は改廃するときは、この条例の趣旨を尊重し、この条例に定める事項との整合性を図るものとする。
  • (Position of this ordinance)
  • Article 2
  • This ordinance is the highest standard in the management of the the City Council, and when the other ordinances etc. Concerning the City Council are enacted or abolished, the purpose of this Ordinance is esteemed, and the consistency with the matter set forth in this Ordinance shall be considered.

  • 第３条
  • この条例において、次の各号に掲げる用語の意義は、当該各号に定めるところによる。
  • (1)市民 市内に住み、市内で働き、若しくは市内で学ぶ人又は市内に事業所を置き、市内で事業活動を行う者をいう。
  • (2)市長等：市長その他の執行機関をいう。

  • The City Council shall assume the role listed in the following issues.
  • (1)As a decision making system,to deliberate and to review the bill and to make the decision of the city.

  • (3)To conduct research on the issues of the municipal government,and to conduct policy planning and recommendations.

  • 第２章　議会及び議員の活動原則
  • （議会の活動原則）
  • 第５条
  • 議会は、その役割を果たすため、次の各号に掲げる原則に基づき活動するものとする。
  • (1)住民の代表機関であることを常に自覚し、公正性、透明性及び信頼性を重んじた、市民にわかりやすい開かれた議会を目指すこと。
  • (2)議会が、討議の場であるとの認識に立って、市民の参加の機会を確保し、市政の課題等の解決のために尽力すること。
  • (3)自由かったつな討議を行い、市政の課題等に関する論点及び争点を明らかにし、政策提言、政策立案等に努めること。
  • (4)議会の活動について、積極的な情報公開を行い、もって市民への説明責任を果たすこと。
  • (5)積極的な調査研究活動に努めるとともに、継続的な議会改革に取り組むこと。

  • The City Council shall, in order to fulfill its role, act on the principles set forth in the following issues.
  • (1)In recognition of being a representative organization of the inhabitants, and by respecting, fairness, transparency, citizens reliability to aim to be open council that is easy to understand.
  • (2)In recognition of being a place for discussion, to ensure the opportunity for citizens to participate and strive to solve the problems of the city administration.
  • (3)Through a free and generous discussion to clarify issues and issues related to the city's problems, and to make policy recommendations and policies.
  • (4)To disclose information about the activities of the City Council actively and to fulfill accountability to citizens.
  • (5)To endeavor to actively conduct research activities and to address reforms of the City Council.

  • (3)To conduct activities aiming to improve the welfare of the entire citizen.
  • (4)To explain menbers own activities.
  • (5)To conduct research and study on the municipal government and to propose bills if necessary.
  • (6)To endeavor to prioritize activities of the City Council.

  • 第７条
  • 議員は、住民全体の代表者として高い倫理観を持って、誠実かつ公正に活動するものとする。
  • ２　前項に規定するもののほか、議員の政治倫理に関する事項については、別に条例で定める。

  • 議会は、公聴会及び参考人制度等の活用や広報広聴機能の強化により、市民の多様な意見を把握し、議会活動に反映させるとともに、市民が議会の活動に参加する機会の充実に努めるものとする。
  • ２　議会は、市民の参加の推進に努めるとともに、市民との意見交換の場を設けるものとする。

  • 第１０条
  • 議会は、請願及び陳情を幅広い提案又は意見と位置付け、適切に処理するものとする。
  • ２　議会は、請願及び住民による陳情の提案者から申出があったときは、 当該提案者の意見を聴く機会を設けることができるものとする。
  • ３　議会は、採択した請願及び住民による陳情のうち市長等において措置することが適当と認めるものについては、市長等に送付した後、その処理の経過及び結果の報告を求めるものとする。

  • 議会と市長等との関係は、その立場及び権能の違いを踏まえ、緊張関係の保持に努めるものとする。
  • ２　議会は、市長が提案する重要な政策、施策、計画、予算等（以下「政策等」という。）については、議会審議を通じて政策水準の一層の向上を図るため、市長に対し、必要な情報を明らかにするよう求めるものとする。

  • 議会は、提案される政策等について、議会審議に資するため、提案者に対し、次の各号に掲げる事項について明らかにするよう求めるものとする。
  • (1)政策等の提案に至った経緯又は理由
  • (2)検討した他の政策等案の内容
  • (3)他の自治体の類似する政策等との比較検討
  • (4)市民参加の実施の有無とその内容
  • (5)総合計画における根拠又は位置付け
  • (6)根拠法令、根拠条例等
  • (7)政策等の実施に要する経費及び財源
  • (8)将来にわたる政策等の効果及び経費
  • ２　議会は、政策等及び決算を審議するに当たっては、立案及び執行における論点及び争点を明らかにするとともに、執行後における政策評価に資する審議に努めるものとする。

  • 2. The City Council, in deliberating policies, etc.and the settlement of account, shall endeavor to clarify the issues in the planning and execution of the program and shall make efforts to contribute to the policy evaluation after execution.

  • 第１５条
  • 会議において、議員の質問又は質疑（以下「質問等」という。）に対し答弁をする者は、質問等の論点及び根拠等を明確にするため、議長又は委員長の許可を得て、反問することができる。
  • ２　議員は、会議において質問等を行うに当たっては、質問等の論点及び根拠を明確にし、市民に分かりやすい方法で行うよう努めるものとする。
  • ３　議員の市長等に対する質問は、広く市政の課題に関する論点及び争点を明らかにするため、一問一答の方式で行うことができる。
  • ４　議長は、議員又は委員会による条例の提案及び議案の修正の提案に対し市長等が意見を述べる機会を与えることができる。

  • 議員は、閉会中に議長を経由して、市長等に対し文書により質問を行い、文書による回答を求めることができる。
  • ２　前項の閉会中の文書による質問に関し必要な事項は、議長が別に定める。

  • Article 16
  • The City Council members, during the closing period of the City Council, through the Chairperson, may ask the mayor or other questions by document and request a written answer.

  • 地方自治法（昭和２２年法律第６７号。以下「法」という。）第９６条第２項に規定する議会の議決すべき事件は、次に掲げるものとする。
  • (1)基本構想（北本市自治基本条例第１１条第１項に規定する基本構想をいう。以下同じ。 ）の策定、変更又は廃止に関するもの
  • (2)基本計画（基本構想を実現するための基本的な計画で、市政全般に係る政策及び施策の基本的な方針を総合的かつ体系的に定めるものをいう。 ）の策定、変更又は廃止に関するもの

  • (2) Basic Plan (Basic plan for realization of basic concept) shall be a comprehensive and systematic policy of policy and measures pertaining to general administration.
  • 2. The City Council, in the deliberations of the cases listed in the preceding paragraph, shall endeavor to discuss with the mayor, etc,with the responsibility to the citizens, to be a highly transparent city administration with a planned and civil perspective.

  • 第５章　議会運営
  • （定例会）
  • 第１８条
  • 法第１０２条第２項に規定する議会の定例会の回数は、毎年４回とする。
  • ２　議会の定例会は、毎年３月、６月、９月及び１２月に招集する。ただし、都合により繰り上げ、又は繰り下げることができるものとする。
  • ３　議会は、必要な審議日数を適切に確保し会期を定めるものとする。

  • The number of regular conference of the City Council, as stipulated in article 102, paragraph 2 of the law (regular meeting), shall be four times annually.
  • 2. The regular meetings of the City Council are convened in March,June, September and December every year.However, it shall be able to change back and forth by circumstances.
  • 3. The City Council shall properly secure the required day of deliberations and determine the period.

  • 議長は、議会の代表者として、中立かつ公平な立場においてその職務を行い、民主的かつ公正な議会運営を行わなければならない。

  • The Chairman of the City Council shall perform its duties in a neutral and impartial position as a representative of the City Council and perform a democratic and fair City Council operation.

  • 議会は、災害時においても、議会機能を的確に維持しなければならない。
  • ２ 災害時の議会の行動基準等に関しては、議長が別に定める。

  • The City Council shall maintain the function of the legislature precisely in the event of a disaster.
  • 2. The Chairperson shall be set aside for the standards of conduct of the City Council in the event of a disaster.

  • 第２１条
  • 常任委員会、議会運営委員会及び特別委員会（以下「委員会」という。）は、調査、研究及び審査を充実させるため、必要に応じて委員相互間の討議を行うよう努めるものとする。
  • ２　委員会は、公聴会及び参考人制度の活用に努めるものとする。
  • ３　委員会は、政策立案及び政策提案を積極的に行うよう努めるものとする。
  • ４　議会運営委員会は、法第１０９条第３項に規定する調査又は審査とともに、議会運営についての協議を行うものとする。

  • 議会は、言論の府であることを認識し、議員相互間の自由かったつな討議を中心とした会議の運営に努めるものとする。
  • ２　議会は、議案の審議及び審査においては、議員相互間の自由討議により議論を尽くして合意形成に努めるとともに、市民に対する説明責任を果たすものとする。
  • ３　議会は、市政に関する政策等及び課題等に対して議員相互間の共通認識及び合意形成を図り、意見集約がなされた内容について、条例の提案、議案の修正、決議等に向けた政策立案を行い、又は市長等に対し政策提言を行うものとする。
  • ４　議員は、議会の機能を発揮するため、積極的に議員相互間の自由討議に努め、議論を尽くすものとする。

  • 2. The City Council shall, in the deliberations and inspection of the bill, endeavor to make the consensus by free and exhorting discussion among the City Council members kers and to fulfill the accountability to the citizens.
  • 3. The City Council shall make a consensus and an agreement among the City Council members about policies and issues related to the city etc.,and shall make an ordinance, an amend of the bill,a resolution,or shall propose the te to the mayer.
  • 4. The City Council members shall endeavor to conduct free discussion actively to activate the function of the City Concil.

  • 議会は、法第１００条の２に規定する学識経験を有する者等による専門的事項に係る調査を積極的に活用するものとする。

  • The City Council shall actively use investigations pertaining to specialized matters by persons who have the academic experience prescribed in article 100-2 of law.

  • The City Council shall endeavor to use the hearings and the reference system in the main conference.

  • 議会は、審議会、審査会、調査会その他の審査、諮問又は調査のための機関を置くことができる。
  • ２　前項の審議会等の機関に関し必要な事項は、条例で別に定める。

  • 議会は、情報技術の発展を踏まえた多様な広報広聴媒体を活用することにより、より多くの市民が議会活動に関心を持つよう議会広報広聴活動に努めるものとする。
  • (Enhancement of public hearing and communication function)

  • The City Council shall endeavor to listen to public relations with more citizens interested in the City Council activities by utilizing a wide range of public relations listening media based on the development of information technology.

  • 議会は、議員の資質の向上を図るため、議員研修の充実に努めるものとする。
  • ２　議会は、学識経験を有する者及び市民との議員研修会を積極的に開催するものとする。
  • ３　議会は、一般選挙後の議員の任期開始後速やかに、議員に対し、この条例に関する研修を行うものとする。
  • ４　議会及び議員は、市政の課題等を広い視点から捉えるため、他の自 治体の事例等を調査研究するよう努めるものとする。
  • (Study and training of the City Council members)
  • Article 31
  • The City Council shall endeavor to enhance the study and training of the City Council members in order to improve the qualifications of the members.
  • 2. The City Council shall actively hold a the City Council study and training session with persons and citizens with academic experience.
  • 3. The City Council shall conduct study and training on this ordinance to the City Council promptly after the start of the term of the general election.
  • 4. The City Council and members shall endeavor to investigate the case of other municipalities in order to grasp the problems of the municipal government from a broad perspective.

  • 第３２条
  • 議会事務局は、議員の議会活動に必要とされる行政情報の収集及び提供に努めるものとする。
  • ２　議会は、議会の機能を充実させるため、議会活動を補佐する議会事務局の調査機能及び法務機能の充実強化並びに組織体制の整備を図るよう努めるものとする。
  • (Secretariat of the City Council)
  • Article 32
  • The secretariat of the City Council shall endeavor to collect and provide administrative information necessary for the City Council member's activities .
  • 2. In order to enhance the functions of the City Council, the City Council shall endeavor to reinforce the investigation function of the secretariat and the improvement of the legal function and the establishment of the organization system to assist the the City Council activity.
  • （議会図書室の充実強化）
  • 第３３条
  • 議会は、議員の議会における審議及び調査研究に役立てるため、必要な資料等を収集保管し、議員に積極的な情報提供を行う等、議会図書室の充実強化に努めるものとする。
  • ２　議会は、議会図書室の市民等の閲覧利用に配慮するものとする。
  • ３　前２項に規定するもののほか、議会図書室に関する事項については、議長が別に定める。
  • (Reinforcement of the Library of Congress)

  • The Assembly shall endeavor to enhance the Assembly library by collecting and storing necessary materials and providing positive information to lawmakers in order to use them for deliberations and research studies in Parliament.
  • 2. The Congress shall consider the use of the citizens of the Parliamentary library.
  • 3. In addition to the provisions of the preceding two paragraphs,the Chairperson shall be set aside for matters pertaining to the Parliamentary library.
  • （議会改革の推進）
  • 第３４条
  • 議会は、継続的な議会改革に取り組むものとする。
  • ２ 議会は、前項の規定による取組を行うため、議員で構成する議会改革を推進する組織を設置することができる。
  • ３　議会は、必要があると認めるときは、前項の議会改革を推進する組織に学識経験を有する者等を構成員として加えることができる。
  • ４　議会改革を推進する組織に関する事項は、議長が別に定める。
  • (Promotion of parliamentary reforms)
  • Article 34
  • The Congress shall address ongoing parliamentary reforms.
  • 2. The Congress may establish an organization that promotes parliamentary reforms constituted by lawmakers in order to make efforts under the provisions of the preceding paragraph.
  • 3. When the Congress finds it necessary, it is possible to add the person who has the academic experience to the organization which promotes the parliamentary reform of the preceding paragraph as a constituent member.
  • 4. The Chairman shall separate matters concerning the organization which promotes the reform of Congress.

  • 第７章　議員定数、議員報酬等
  • （議員定数）
  • 第３５条
  • 法第９１条第１項に規定する議会の議員の定数は、２０人とする。
  • ２　議員の定数の変更に当たっては、市政の現状及び課題、将来の予測、市民の意見その他の事情を十分に考慮するものとする。

  • The constant number of the City Council members, as stipulated in article 91, of the law, shall be 20.

  • 議員は、議会活動を円滑に行うため、会派を結成することができる。

  • The City Council member may form a faction to facilitate the City Council activities.
  • （政務活動費）
  • 第３８条
  • 政務活動費は、議会の充実等に資するため、議員の政策立案及び調査研究等の活動に充当できるものとする。
  • ２　政務活動費は、活動成果の報告に努める等、説明責任を果たし、適正に取り扱うものとする。
  • ３　前２項に規定するもののほか、政務活動費に関する事項については、別に条例で定める。
  • (Expenditure of government activities)

  • In order to contribute to the enhancement of the the City Council,the expenditure of government activities shall be applicable to the activities of policy planning and research of the City Council.
  • 2. The expenditure of government activities shall be handled in a manner appropriate to the report of the results of the activities, etc.
  • 3. In addition to those stipulated in the preceding two paragraphs,matters concerning the expenditure of government activities shall be stipulated separately in an ordinance.

  • 議会は、議会運営委員会において、この条例の不断の検証に努め、市民の意見、社会情勢の変化等を勘案し、必要があると認める ときは、条例の見直しを行うものとする。

  • The City Council shall review the Ordinance when it finds that it is necessary to make constant verification of this Ordinance and to take into consideration the change of citizens' opinions and social situations, etc. in the City Council steering committee.

  • （施行期日）
  • １ この条例は、公布の日から施行する。
  • （北本市議会の定例会条例等の廃止）
  • ２ 次に掲げる条例は、廃止する。
  • (1) 北本市議会定例会条例（昭和３１年条例第４号）
  • (2) 北本市議会の議員の定数を定める条例（平成１４年条例第３３号）
  • (3) 北本市議会の議決すべき事件を定める条例（平成２７年条例第３１号）
  • Supplementary provisions
  • (Enforcement date)
  • 1. This Ordinance shall be enforced from the day of promulgation.
  • (Abolition of the Regular Meeting Ordinance of the Kitamoto City Council)
  • 2. The following ordinance shall be abolished.
  • (1) the ordinance for Kitamoto City Council regular conference (Ordinance No. 4, 1954)
  • (2) the ordinance to determine the constant number of the Kitamoto City Council members (Ordinance No. 33 of 2002)
  • (3) the ordinance to determine the event to be voting for Kitamoto City Council (Ordinance No. 3, 2015)
